The Michigan State Police details on its official website the strict rules that all drivers must follow when traveling on public roads.

The authorities state that “according to current legislation, a driver may not hold or grasp a phone or other device with any part of their hands, arms, or shoulders”.

This regulation applies even when the driver is waiting at a traffic light with the phone in hands-free mode. Cell phone use is allowed only for a single initial touch.

It is prohibited to hold or manually use a mobile phone or other mobile electronic device at any time while driving a vehicle. This includes situations in which the vehicle is stopped at a traffic light or in traffic, though not when it is legally parked, as stipulated.

The hands-free function -implemented through Bluetooth or other systems integrated into the vehicle- may be used without issue. However, any driver who actively uses their cellphone with more than one touch will be penalized, even if the vehicle is stopped at a traffic light.

Fines for violating traffic rules: How much will drivers have to pay?

According to state law, using or handling a mobile device while driving constitutes a primary offense. If detected for the first time, a fine of USD 100 and/or 16 hours of community service will be imposed.

If two additional violations are recorded, the penalty will rise to USD 250 and/or 24 hours of community service. If three violations occur within a period of less than three years, it will be mandatory to complete a driver improvement course.

Authorities warn: in a traffic accident, if the responsible driver was handling a mobile device while driving, the civil fine will be doubled.
